Foul Play
For more than 6 years Foul Play™️ has been creating crime series based our own investigation. Our cases are introduced in individual seasons and feature interviews from involved parties. We have helped to identify 3 Jane Doe victims, solve a serial killer case from the 1980s, and continue to work on the unsolved murder of Sister Cathy as featured in Netflix's docu-series 'The Keepers'. Hosted by crime journalist Shane Waters & Wendy Cee
This episode begins after the grisly discovery of Asta Eicher and her three children’s remains at the Garage of Harry Powers; who is currently in custody at the Clarksburg West Virginia Police Department.
He said he knew nothing about their deaths. Mobs surrounded the stations, angry wanting to lynch Harry for his crimes. “Bring the man out!” they shouted angrily.

An arrest warrant was issued for Cornelius Pierson, who turned out to be Harry F. Powers of Clarksburg, West Virginia. Catfishing is a term most people recognize today as someone who pretends to be someone else - most of the time when meeting over online dating sites. It seems Harry learned to hunt his prey by catfishing over the letters he would write.

On November 5, 1990, Ghislaine Maxwell flew to New York to hand deliver an envelope for her Father. What she did not know was that this envelope was part of a plot, that Robert Maxwell had initiated to steal $200m from the shareholders of Berlitz Corporation. Exactly a year later his naked body would be found floating in the Atlantic.

The Maxwell family were initially poor but as Robert Maxwell’s empire grew, so did the families wealth, and in 1959 they moved into Headington Hill Hall in Oxford, which they rented from Oxford City Council. Headington Hill Hall was a huge, imposing building, with the oldest part of the building dating back to 1824. The house was originally built for a local brewing family, called the Morrell’s.

The huge maps that Shermantine was drawing WERE accurate, it was time to look into other locations that he had marked. It was time to bring home the other missing people, to end this horrendous ordeal for those other families that had spent years not knowing what happened to their loved ones.
Surely, with the assistance of Shermantine and his maps, along with the correct resources, this should be relatively simple, shouldn’t it?

On July 31, 2001, jury selection began in Herzog's murder trial. The trial was also held in Santa Clara County, due to the notoriety of the pair and concerns that it would not be a fair trial otherwise. After two weeks of deliberations, the jury returned with 3 counts of murder for Cyndi Vanderheiden, Paul Cavanaugh, and Howard King - and for being an accessory to the murder of Henry Howell. On December 10th, 2001, Herzog was sentenced to 78 years in state prison.

All seemed well in and around the community of Linden, California, in the early 1980s. Methamphetamine made its way into the life of many impressionable young people as they navigated a social life outside of High School. It's not uncommon for two best friends to enjoy hunting, but unbeknownst to the community, Wesley Shermantine and Loren Herzog decided they would start hunting people. Their reign of terror spanned for 15 years and their victim count is estimated conservatively at 60 people. How did the two serial killers get away with dozens of murders for so long? Why did the two evolve from hunting animals to humans? Who fell victim to their torture? Join us as we dive deep into the case.

Book Description: Fifty years ago, beloved teacher Sister Catherine Cesnik was the victim of a brutal unsolved murder. Ever since then, her students, colleagues, friends, and family have all been asking the same question: who killed Sister Cathy? Gemma Hoskins is one of Sister Cathy’s formers students. She appeared on The Keepers, the 2017 Emmy-nominated Netflix docuseries that had the world also wondering what happened to Sister Cathy. Gemma has been both deeply inspired and haunted by Sister Cathy’s life and death, leading her to decide to make her life’s purpose to uncover what really happened that November night in 1969. In Keeping On, Gemma takes readers on a journey of her life, from her time as Sister Cathy’s student at Archbishop Keough High School through present day. She reflects upon the experiences that have shaped her, including her personal experience as a teacher, grassroots investigator, and fierce advocate for truth and justice. Gemma openly continues the search for the truth behind Sister Cathy’s murder, but also reflects upon how Sister Cathy’s life profoundly impacted those who knew and loved her.

50 years ago today, at approximately 7 pm Eastern Time, Sister Cathy would leave her Carriage House Apartment for the very last time. The world has become aware of Cathy’s tragic fate that night - so today Gemma and I ask you to take a moment to remember Cathy. You see, Cathy was a real person, with dreams and goals of her own. On November 7th, 1969 Cathy’s life was taken - but her memory lives strongly in those whose lives she touched. These are some of those memories…

During last week’s conversation with MKUltra Survivor, we discussed briefly some of the documents the CIA released that touched slightly on their psychological testing done under MKUltra. What I am about to read to you is a redacted CIA document from 1951, two children were used in the experiment and the document explains both are young girls. Although this document does not talk about sexual testing, please be advised that what you are about to hear may be triggering if you are a survivor. This document is proof of one type of testing the CIA did on children involving being in a trance and ensuring their subjects had complete amnesia. *** TRIGGER WARNING ***

**TRIGGER WARNING** Jean is aware that the topic we are about to discuss is difficult to hear, so she warns that the conversation you are about to listen to is painfully raw and can’t help but be upsetting, especially if you are a survivor. However, it is necessary to talk about such things in order for us to separate victim from abuser, so we can see how systematically premeditated Maskell and other perpetrators are in their efforts to make their victims believe they are solely responsible for what happened to them. Knowing how triggering it is for her to just talk about what the abusers made her do, feel & think she recommends that survivors have their therapists or close supporters listen to this 3 part interview before or with them. As always don’t feel you need to listen!

Many of you have been reaching out asking where you can find two episodes Gemma and I have referenced in the podcast a few times on Kelly the Box Girl. In February of 2018, Gemma and I worked together to chase a promising lead after The Keepers was released. The two episodes are really far back in the podcast’s archives so to help listeners find it we decided to release the two episodes combined for this week’s episode in our Sister Cathy series. What you are about to hear is a series of odd events that resulted in us trying to track down a box of what seemed to be very important evidence. Stick around to the very end to hear our conclusion.

A few weeks ago we shared that House Bill 687, also known as The Hidden Predator Act of 2019, was being sponsored by CT Wilson. House Delegate Wilson’s Bill would end Maryland’s statute of limitations for civil claims against perpetrators of child sex abuse - and would also include a 2 year look-back window, a time which victims could bring claims in cases where the previous statute of limitations has expired. If you’ve seen The Keepers, you will remember Delegate Wilson speaking on his experience as a survivor and how hard it is to pass laws that the Archdiocese fights against.
This week we want you to hear Delegate Wilson’s speech as well as the back and forth in Annapolis, Maryland in March at the Judicial Proceedings Committee. 1 in 4 girls and 1 in 6 boys are sexually abused in the United States - and to this day most still have not disclosed their abuse publicly.

Around the same time Sister Cathy went missing in 1969, Father Maskell started looking for a confidential secretary. Student Lil Hughes (Knipp) agreed to fill this position.
Some episode corrections: Lil has 7 siblings, not 8. Her dad was in the service but was home for Christmas. When Lil mentioned that those who work in a private school has access to a lot of information, she would like to clarify that files are kept confidential HOWEVER she believes Fr Maskell bullied the nuns at the school and acted as though he was the person in charge. This provided him with access to private and confidential information on students.

In last week’s interview with Sean Caine from the Archdiocese of Baltimore - one of the subjects we discussed was when abuse allegations against Father Maskell first happened. Caine says according to their documents the first accusations were in the 90s when Jean Wehner came forward during the Doe/Roe lawsuit. When asked about Charles’ statement that his mother went to the diocese when he as being abused, Caine said they have no documentation of it happening. What we know is that after Charles’ mother found out, Maskell was moved. Now we bring you the story of another who says they too reported the abuse - which resulted in Fr Maskell being removed from Archbishop Keough High School.

Part 1: I’ve seen it before, a cold case stays unsolved until someone comes forward with information they thought was unimportant. It’s an important lesson to learn - if you know anything, no matter how insignificant and small you think it may be, it may be an important piece to the larger puzzle. We have thought for a long time that surely Cathy’s friend and roommate Sister Russell must have known of the abuse at Keough - and wondered if they ever told the police. Now - we have a first-hand eye witness account of the man in the trench coat.

Please be advised this episode contains content and language that is graphic in nature, listener discretion is strongly advised. Where were you at in life at the age of 13? Personally, I remember being in 8th grade using my free time to binge read Harry Potter books. Charles Franz had a much different experience… For more than 5 years Charles fell victim to a predator - someone he knew as Father Joseph Maskell. You have heard from female survivors so far in this series, but Maskell’s reign of terror wasn’t limited to gender or age. Charles is an amazing person, we thank him for sharing his story with us. Sharon’s uncle Billy happens to live in the apartment complex, granting him access to always being able to know when Cathy enters and leaves. He could easily be seen as someone who wouldn’t bring attention to himself for lingering around the place while waiting for Cathy to return home from shopping. And conveniently her car is later dropped just around the corner to his patio door. Sharon joins us again to talk more about her Uncle Billy - I will leave it up to you to decide what is more than just a coincidence.

Although several victims of Father Maskell came forward in the 90s, Sharon May at the prosecuting office refused to go forward with charges. Many questions arose as to why in 'The Keepers' Sharon May suggested she just didn’t think she had enough to convict him of charges… more on this later. When criminal charges were going nowhere, two women, who choose to keep their identity secret, came forward to sue in civil court: Jane Doe and Jane Roe.

Today you are going to hear from a very brave survivor who wasn’t featured in The Keepers. Michele Stanton can link Edgar Davison with Officer James Scannell, a very important connection.
